The Second Chamber of the Supreme Court (TS) has requested the Superior Court of Justice of the Valencian Community (TSJCV) the order issued on March 16 of this year, in which this body rejected assuming jurisdiction to investigate the 'former president' of the Generalitat Carlos Mazón for his actions during the flood of October 29, 2024, in order to assess whether it is appropriate to open a case for false testimony.
According to the resolution accessed by Europa Press, the High Court thus responds to the request of the Prosecutor's Office to incorporate that order into the procedure derived from the complaint filed by the PSPV-PSOE against Carlos Mazón for false testimony in Congress.
Once the TS formally receives the order, the Public Prosecutor's Office must issue a report on the jurisdiction of the Supreme Court itself and on the content of the complaint --that is, whether it sees sufficient indications for its admission to processing-- and, after that, the Chamber will issue its own order in which it will rule both on the jurisdiction and on the admission or not of the complaint.
In the complaint from the PSPV-PSOE, it was indicated that the 'former president' appeared on November 17, 2025, before the Investigative Commission of the Congress of Deputies regarding the management of the crisis caused by the flood, where he was "expressly" warned of the legal obligation not to lie in his testimony, according to article 502.3 of the Penal Code.
However, the socialists maintained in their writing that Mazón "lied" regarding the list of calls made that day; the route after leaving the restaurant El Ventorro; the knowledge of the existence of deceased persons; the aid sent by the Government of Spain and its destination, as well as the communications maintained with the then councilor of Justice and Interior, Salomé Pradas, investigated in the Catarroja case.
The TSJCV rejected in March of this year the reasoned exposition sent by the judge of Catarroja to investigate Mazón, as it found a lack of criminal indications and absence of "guarantor position," and concluded that holding the political and hierarchical position of president of the Consell "does not automatically imply criminal responsibility of this type." As he did not specifically hold the "guarantor position" regarding the risk, it considered that he could not be attributed a crime of homicide by negligence in the modality of commission by omission.
In relation to the complaint, the Prosecutor's Office emphasized that "lying, as the essence of the type of article 502.3 CP, means that there must be a substantial alteration of the truth, understood as an unequivocal contradiction with objective reality, within the framework of the responses of the declarant to the questions posed, and those responses must affect relevant facts."
For this reason, to assess whether what was stated by Mazón in Congress was "relevant," the Public Ministry understood that it is "where the order dated March 16, 2026, issued by the TSJCV must be brought to the case." Consequently, it requested the TS Chamber to demand from the high Valencian court the certified submission of the order of March 16, 2026, and that it be transferred to carry out that analysis. The Supreme Court has agreed to this request.
