The Provincial Court of Almería has imposed a four-year prison sentence on a man, in addition to nine years of internment in a medical treatment center, for having attempted in July 2022 to suffocate a woman to death on a beach in Vera (Almería).
The resolution, which is final as an agreement has been reached between the parties, considers the accused responsible for a crime of attempted homicide, applying the mitigating factor of damage repair, since before the oral hearing he provided compensation to the victim, and the incomplete exemption of mental alteration.
According to the sentence, consulted by Europa Press, at the time of the events the defendant presented a bipolar disorder in manic phase with psychotic symptoms, a circumstance that notably affected his volitional and intellectual capacities.
In line with the Prosecutor's written statement, the court accepted the partial exemption of criminal responsibility of the man, who paid the victim economic compensation of 8,120 euros. Furthermore, he is prohibited from communicating with her or approaching within 200 meters for a period of 14 years.
The events occurred on July 12, 2022, on the Ventanicas beach in Vera, when around 7:00 a.m. the man approached the woman "with the intention of causing her death," initiating an attempt to suffocate her until the victim lost consciousness and fell to the ground.
However, another man surprised him in the middle of the attack, which caused the aggressor to flee the scene and thwarted his objective. The woman had to be treated at the Huércal-Overa Hospital for the injuries suffered, from which she took about 45 days to recover physically.
