The Court of First Instance and Instruction No. 6 of Ceuta has decided to open preliminary proceedings following a complaint filed by Hazte Oír regarding the alleged distribution of devices used by migrants. In a separate procedure, the same judicial body has admitted another complaint from the association against the Government Delegate, Miguel Ángel Pérez Triano, and has incorporated it into ongoing proceedings.
Regarding Pérez Triano, the court has agreed to accumulate the complaint from Hazte Oír to the Preliminary Proceedings 473/2026, which were in processing following the legal action promoted by Manos Limpias.
The judicial body has recognized the association as a popular accusation in this procedure, in which the actions of the authorities during the mass entry of migrants recorded in Ceuta at the end of July are analyzed.
In its complaint, alleged crimes of prevarication, omission of the duty to prosecute crimes, denial of assistance, and homicide and injuries due to gross negligence by omission are indicatively attributed to Pérez Triano.
Hazte Oír also extends the criminal action to other authorities and public employees who may have responsibility in the investigated events.
The association has requested the practice of various proceedings to clarify the decisions made during that crisis and to ensure the preservation of documentation and official communications related to those events.
It will now be up to the Public Prosecutor's Office to rule on the proceedings requested by Hazte Oír.
Investigation into the distribution of devices
In a different procedure, the same court has agreed to initiate preliminary proceedings to clarify the alleged distribution of devices to migrants during the incidents recorded in the city in recent weeks.
The order, dated this Thursday, notes that the facts present features that allow for the presumption of the possible commission of an alleged crime of public disorder, among others.
The investigation aims to specify the nature and context of the events, as well as the identity of the individuals who may have intervened. Hazte Oír requests that it be determined who acquired, manufactured, transported, stored, supplied, or distributed the devices and how they arrived in Ceuta.
The association also requests that it be investigated whether there was coordination or encouragement of violent behaviors and whether individuals linked to organizations operating in the city intervened.
The entity also demands the issuance of police and expert reports, the identification of possible responsible parties, and the preservation of recordings and records. Against the resolutions issued in these cases, the resources provided for in the Criminal Procedure Law can be filed.
