The magistrate of Badajoz Beatriz Biedma, responsible for the investigation into David Sánchez, brother of the President of the Government, has declared before the judge of the "Leire Díez case," Santiago Pedraz, that she came to feel persecuted, distressed, and uncomfortable due to various situations of alleged harassment attributed to the former judge Luis Sáenz de Tejada, whom the Civil Guard links to the alleged plot. However, she emphasized that these facts did not influence her work at the head of the case related to the brother of the head of the Executive.
According to legal sources informed to Europa Press after her appearance as a victim before Pedraz, the statement is part of the investigation into a possible network aimed at obstructing judicial proceedings affecting the PSOE and that, according to the investigations, would have been led by the former socialist leader Santos Cerdán and coordinated by the former socialist militant Leire Díez.
Biedma's appearance comes a day after a report from the Central Operational Unit (UCO) of the Civil Guard was made known, in which the investigators link the alleged "Leire plot" with Sáenz de Tejada. This document includes the testimony of a witness who attributes to the former magistrate having spoken of "eliminating" Biedma because she was "a fucking pain in the ass."
According to the same sources, Biedma has stated to the judge that she does not personally know Leire Díez nor has evidence that she was behind the episodes that made her feel uncomfortable, nor of the videos that Sáenz de Tejada spread on Youtube against her and that the judge provided to the court as evidence of the alleged harassment.
PRESSURES IN THE UCO
The judge also explained that the UCO agents who carried out the proceedings regarding Sánchez's brother informed her that they had felt pressured. In response, Biedma ordered them not to send their reports to the higher commands, according to the same sources.
Pedraz agreed to admit Biedma as a private prosecution considering that she is indicatively harmed "at least for the crime of defamation, without prejudice to what results from the subsequent instruction of the case in relation to the rest of the crimes she imputes."
The magistrate requested to appear as a harmed party understanding that she had been the object "of actions aimed at obtaining information about her, discrediting her publicly and professionally, promoting complaints and grievances against her, gathering information about her environment and removing her from specific judicial proceedings."
In her account, Biedma has placed the origin of Sáenz de Tejada's animosity in the proceedings opened after the separation of the former judge and his ex-wife, who reported him for an alleged crime of gender violence. As she explained, Sáenz challenged the judge initially in charge of the matter alleging friendship with his ex-partner, and the case ended up being assigned to Biedma.
Subsequently, the former magistrate filed a complaint against all the judges involved in that procedure for an alleged criminal organization. That episode would have marked, according to the consulted sources, the beginning of the deterioration of the relationship and the alleged harassment through videos and other actions.
Before Pedraz, Biedma described two episodes that caused her particular distress. In one of them, when she went to her daughters' school, a person told her that her brother had been asking about them earlier, which alarmed her as she has no brother. On another occasion, she was told that her secretary had shown interest in her daughters, despite the fact that she has no secretary, the sources have specified.
These events made her feel very uncomfortable, distressed, and even persecuted, although she insisted that at no time did they alter her impartiality in the investigation into Sánchez's brother, as she did not relate them to that case or the alleged plot.
THE CLAN OF "LOS ROCHO"
The judge also indicated to Pedraz that a lawyer conveyed to her that Sáenz de Tejada had contacted people linked to a well-known clan, supposedly related to drug trafficking and based in Badajoz, "Los Rocho," with the aim of acting against her.
Among those people would be Cintia Rocho, who stated before the Civil Guard that Sáenz de Tejada told her that Biedma "was a fucking pain in the ass and needed to be eliminated," and that the intention, according to her version, was "to cause physical harm to the magistrate."
In her testimony, Rocho also assured that the former judge told her that Biedma "was the one calling the shots in the courts and that the other judges were influenced by her." "The donkey learns with blows," Sáenz de Tejada would have added, according to the witness.
Biedma has specified before the judge that he knew the clan of "Los Rocho" because he had prosecuted the son and the brother of Cintia, who ultimately went to prison.
