A recent resolution of the Social Chamber of the Superior Court of Justice of Galicia (TSXG) has set the economic compensation at 10,000 euros for each period of three years of abuse of temporality in public administrations.

The ruling, issued in July 2026, upholds the appeal presented by a worker from the Miño-Sil Hydrographic Confederation who reported abuse in the duration of his temporary relationship. This pronouncement follows the line of another previous ruling from the TSXG itself, in which an amount of up to 10,000 euros had already been indicated for each three-year period of temporality in the case of an employee of the Xunta. In both cases, the affected individuals had chained temporary contracts for 22 and 15 years, respectively.

The Galician court understands that the compensation intended to remedy the abuse can be calculated based on the Law on Offenses and Sanctions in the Social Order (Lisos) and establishes a temporal criterion: for each complete period of three years in which the abusive situation is maintained, a new amount of up to 10,000 euros can be generated. All of this, without prejudice to the fact that the amount must be adjusted according to the specific circumstances of each case and other additional damages that may be proven.

To delimit that three-year interval, the Chamber refers to article 70.1 of the Basic Statute of Public Employees (EBEP), which serves as a temporal reference to assess the undue prolongation of the temporary relationship.

In light of this pronouncement, Unive Abogados considers "especially relevant the scope that this criterion may have in future claims, by linking the duration of the abusive situation with the quantification of the damage."

In a public note, the firm emphasizes that this resolution opens a clear avenue for other affected individuals to claim compensations. "Until now, one of the main problems in this type of procedure has been precisely determining how to economically translate an abuse that can last for many years. The use of complete three-year periods as a reference allows for the establishment of an objective parameter for that assessment, although the final amount must continue to be determined individually according to the circumstances of each worker," it explains.

The criterion adopted by the TSXG is based on the most recent doctrine of the Court of Justice of the European Union and the Supreme Court, which requires that measures against abuse in temporary hiring provide an effective response to the repeated and unjustified use of successive temporary relationships.
