The Court of First Instance and Instruction No. 6 of Ceuta has processed a complaint from Hazte Oír regarding the alleged distribution of devices used by migrants and, in a separate procedure, has incorporated into already opened preliminary proceedings the complaint from the association against the Government delegate, Miguel Ángel Pérez Triano.
Regarding Pérez Triano, the judicial body has agreed to accumulate the complaint promoted by Hazte Oír to the Preliminary Proceedings 473/2026, which were being processed following the complaint filed by Manos Limpias.
The court has recognized the association as a popular accusation in this case, in which the decisions made by the authorities during the massive entry of migrants recorded in Ceuta at the end of July are analyzed.
The complaint provisionally attributes to Pérez Triano possible crimes of prevarication, omission of the duty to prosecute crimes, denial of assistance, and homicide and injuries due to serious negligence in commission by omission.
Hazte Oír has also directed action against other authorities and officials who could be held responsible for the investigated facts.
The association has requested the practice of various proceedings to clarify the decisions made during the crisis and to ensure the preservation of documentation and official communications related to those events.
The Public Prosecutor's Office must rule on the proceedings requested by Hazte Oír.
The alleged distribution of devices
In a different procedure, the same court has resolved to initiate preliminary proceedings to clarify the alleged distribution of devices to migrants during the incidents recorded in the city in recent weeks.
The order, dated this Thursday, indicates that the facts present features that allow presuming the possible existence of an alleged crime of public disorder and others.
The investigation aims to determine the nature and circumstances of what occurred, as well as the identity of the individuals who may have intervened. Hazte Oír demands clarification on who acquired, manufactured, transported, stored, supplied, or distributed the devices, as well as how they arrived in Ceuta.
The association also requests to investigate whether there was coordination or encouragement of violent behaviors and whether individuals linked to organizations operating in the city intervened.
The entity also requests police and expert reports, the identification of possible responsible parties, and the preservation of recordings and records. Against the resolutions issued, it is possible to file the appeals provided for in the Criminal Procedure Law.
