The Valencian Anti-Fraud Agency has decided to close the investigation opened regarding the possible irregularity in the Diputació de València related to the temporary provision system, through a commission of services, of the position of executive secretary held by the partner of the 'president' of the Generalitat, Juanfran Pérez Llorca. Ultimately, this person did not participate in the process for the definitive coverage of the position.
The resolution, advanced by 'Las Provincias' and accessed by Europa Press, concludes that there are no "reasonable indications of truth in the facts that have been the subject of the complaint." At the same time, it specifies that all of this is agreed "without prejudice to the possibility of reopening the file in the event that new evidence or indications supporting the allegations made are provided."
In relation to the existence of a vacancy whose coverage was urgent and unavoidable, the document considers that this point is "doubtful" considering the observed timelines: "the position was created on July 23, 2025, without the public announcement for the temporary coverage in commission of services of the executive secretary position being made until January 27, 2026."
According to Anti-Fraud, "the passage of approximately six months between the creation of the position and the start of the coverage procedure is hardly reconcilable with the note of urgency that the provision requires, without any specific motivation being recorded in the file justifying such delay." However, it does appreciate that the requirement for publicity has been respected, given that the position was offered through a public announcement on January 28, 2026, at 09:54 hours, via an advertisement on the Diputació de València website.
Report of suitability and requirements of the position
Regarding the fact that the service commission protocol of the Diputació does not include criteria or scores and is based solely on a suitability report issued by the hierarchical superior of the position, Anti-Fraud indicates that this "does not violate any legal provision." It explains that this system conforms to the doctrine of the Supreme Court, which differentiates between the merit competition —which does require criteria, regulated evaluation, and assessment bodies— and the commission of services, conceived as a mechanism for provisional provision.
Regarding the verification of the requirements and the suitability of the selected person, the agency recalls that, although in a commission of services "it does not require the formalities typical of a merit competition, it must verify compliance with the requirements set forth in the job relationship (RPT) and the suitability of the candidate" and specifies that both aspects "are accredited".
Thus, it was verified the belonging to subgroup C1 as a career civil servant, "one of the candidates was excluded for not proving said requirement", and it was confirmed that Llorca's partner was "the candidate with the most experience in performing C1 administrative staff positions and in specific functions typical of management secretary positions, according to the report of February 13, 2026, among the five candidates presented".
Antifraude also understands that the requirement to foresee the offer of the position in the next ordinary provision call has been fulfilled, "since the position has been offered for its definitive provision by decree of the Presidency of the Diputació nº2967, of March 5, 2026". At this point, the resolution recalls that Llorca's partner "has not participated in said call, which remains pending definitive allocation".
Temporal coincidence and file archiving
In relation to the acceleration of the procedure and the fact that the commission of services was convened two months after the taking of possession of the head of the Consell, Antifraude argues that the "temporal coincidence between both facts does not constitute, by itself, an indication of irregularity nor does it vitiate the legality of the procedure although the doubt remains, not resolved by mere temporal coincidence, but neither cleared by it, about the real motivation of the urgency and non-deferrability that justified resorting to this exceptional figure instead of the ordinary provision systems, given the prolonged period elapsed between the creation of the position (July 23, 2025) and the start of the call (January 27, 2026)".
However, in light of the current situation, the resolution concludes that the object of the action "has lapsed, since the person to whom a presumed preferential treatment was attributed has not presented themselves to the definitive provision call for the position, leaving this subject to the ordinary and regulated channels of the corresponding provision procedure".
For this reason, Antifraude considers it appropriate to file the proceedings due to the unforeseen loss of object, under the protection of article 84.2 of Law 39/2015, of October 1, of the Common Administrative Procedure of Public Administrations. Likewise, it specifies that it "will refrain from initiating investigative actions, given that, from the facts and the reported behaviors, there are no reasonable indications that prove their veracity."
The 'president' of the Generalitat, Juanfran Pérez Llorca, already asked in his day to wait for Antifraude's pronouncement on the hiring of his partner and expressed his "respect for any type of investigation": "Let it be investigated, let it be resolved and then we draw the conclusions, what should not be done is to draw them beforehand." "Let us wait for the resolution, what cannot be is that everyone sentences before things are investigated," he asserted, and emphasized that he has "no problem with things being investigated."
